3. Products and Services

Products and services offered through the Website/App are subject to the descriptions, prices, and terms presented at the time of purchase.

Refund and cancellation terms applicable to a particular product or service will be presented at the time of purchase.

Unless otherwise stated or required by applicable law, completed digital services or assessment reports may not be refundable once the service has been delivered or made available to the purchaser.

Nothing in these Terms limits any non-waivable consumer rights that may apply under applicable law.

6. Website/App Information

We make reasonable efforts to keep information on the Website/App accurate and current. However, we do not warrant that all information, descriptions, availability, pricing, or other content will always be complete, accurate, or error-free.

We may update, modify, suspend, or discontinue portions of the Website/App or its content at any time.

7. DAS Assessment and Professional Disclaimer

The Drawing Analysis System (DAS) is a research-based visual assessment system grounded in psychological and projective research. DAS is designed to provide structured insights based on a user's drawing and coded visual indicators within the DAS system.

DAS is intended to provide assessment information and insights. It is not intended to provide a medical diagnosis and it is not a substitute for a comprehensive psychological, medical, psychiatric, or clinical evaluation by a qualified professional.

DAS results should not be used as the sole basis for diagnosing a mental health condition, making medical decisions, prescribing treatment, or making other high-stakes decisions concerning an individual's health or welfare.

Where professional interpretation is appropriate, DAS results should be considered together with relevant background information, professional judgment, and other appropriate assessment methods.

The Company does not guarantee any particular outcome from the use of DAS.

8. Responsibility for Use and Interpretation

The interpretation and use of DAS results are the responsibility of the user.

Where the DAS system requires a user or authorized tester to select coded visual indicators corresponding to features of a drawing, the accuracy of the resulting report may depend upon the selections made by that user or tester.

Drawing Analysis does not control or independently verify every selection made by users or authorized testers and is not responsible for inaccurate results arising from incorrect, incomplete, or inappropriate selections.

9. Intellectual Property

All intellectual property associated with DAS, including but not limited to its methodology, assessment structure, coded visual indicators, image library, databases, reports, software, algorithms, terminology, graphics, trademarks, logos, and proprietary materials, belongs to Drawing Analysis, Inc. or its licensors.

Except as expressly permitted by these Terms or by written authorization from Drawing Analysis, you may not:

copy, reproduce, modify, translate, adapt, or create derivative works from DAS;
reproduce or distribute DAS images, coded indicators, assessment materials, reports, or proprietary content;
reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying structure of the Website/App;
extract, scrape, download, or systematically collect data or content from the Website/App;
use DAS to create or develop a competing product or service;
reproduce or commercially distribute the DAS methodology or assessment system; or
remove copyright, trademark, proprietary, or other legal notices.

Unauthorized use may constitute infringement of intellectual property or other rights and may result in legal action.

10. Limited License

Subject to these Terms, Drawing Analysis grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website/App for its intended lawful purpose.

This license does not transfer ownership of any DAS intellectual property to you.

Any rights not expressly granted under these Terms are reserved by Drawing Analysis.

11. Prohibited Uses

You agree not to use the Website/App:

(b) to infringe, misappropriate, or violate the rights of another person or entity;

(c) to interfere with or disrupt the Website/App, servers, networks, or security systems;

12. User-Submitted Content

If you submit drawings, photographs, text, comments, feedback, or other materials through the Website/App (“User Content”), you retain ownership of your User Content, except for any rights you separately grant to Drawing Analysis under these Terms or another agreement.

By submitting User Content, you grant Drawing Analysis a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and use that User Content solely as reasonably necessary to provide, operate, maintain, improve, secure, and administer the Website/App and the services requested by you, subject to our Privacy Policy and applicable law.

We will not use your private assessment materials for unrelated commercial purposes except as disclosed in our Privacy Policy or with your consent, where consent is required.

You represent that you have the necessary rights and permissions to submit User Content and that doing so does not violate the rights of another person.

13. Feedback

If you voluntarily provide suggestions, ideas, recommendations, or feedback concerning the Website/App or DAS, you agree that Drawing Analysis may use such feedback without compensation or obligation to you, provided that such use does not disclose your confidential personal information contrary to our Privacy Policy or applicable law.

14. Privacy

Your use of the Website/App is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

The Privacy Policy is incorporated into these Terms by reference.

15. Third-Party Services and Links

The Website/App may contain links to third-party websites, applications, payment processors, hosting providers, or other services.

Drawing Analysis does not control third-party services and is not responsible for their content, availability, security, privacy practices, or terms.

Your use of third-party services may be subject to their separate terms and privacy policies.

16. Security

We take reasonable measures designed to protect the Website/App and information processed through it. However, no website, application, transmission, or electronic storage system can be guaranteed to be completely secure.

You acknowledge that you use the Website/App at your own risk and agree to promptly notify us if you become aware of unauthorized access to your account.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE/APP AND ITS CONTENT AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

DRAWING ANALYSIS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY, EXCEPT TO THE EXTENT SUCH DISCLAIMERS ARE PROHIBITED BY LAW.

WE DO NOT WARRANT THAT THE WEBSITE/APP WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAWING ANALYSIS, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE/APP OR DAS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE WEBSITE/APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DRAWING ANALYSIS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Drawing Analysis, Inc. and its officers, directors, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising out of or related to:

(a) your violation of these Terms;

(b) your misuse of the Website/App or DAS;

(c) your User Content; or

(d) your violation of the rights of another person or entity.

20. Termination or Suspension

We may suspend or terminate your access to the Website/App if we reasonably believe that you have violated these Terms, engaged in unlawful activity, created a security risk, or otherwise misused the Website/App.

You may stop using the Website/App at any time.

Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, dispute provisions, and governing law—will survive termination.

21. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that applicable consumer-protection laws require otherwise.

22. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Website/App shall be handled in accordance with applicable law.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect.

27. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.

28. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms specifically applicable to particular products or services, constitute the agreement between you and Drawing Analysis regarding your use of the Website/App.
